A Spanish court has sentenced the woman who publicly accused DJ Guy Gerber of rape to 15 months in prison, after concluding that the allegation was false and unsupported by evidence. The ruling follows a judicial review of claims that circulated widely on social media several years after the alleged events.
According to the court, the accusation lacked any form of contemporaneous proof, including medical reports, toxicology results, police complaints, or witness testimony. The judge determined that the events described in the public statements could not be substantiated and ruled that the accusation did not correspond to the facts.
The case stems from allegations made online in which the woman claimed that Gerber had drugged and raped her following a party years earlier. Gerber denied the accusations from the outset and pursued legal action in response, maintaining that the claims were false and damaging to his reputation.
In its decision, the court classified the conduct as a criminal offense of false accusation with public dissemination under Spanish law, noting the serious impact such statements can have when shared publicly and without evidence. Beyond the prison sentence, the ruling also requires the woman to publicly acknowledge the court’s decision on her social media channels for a defined period.
